How do you deal with this rating issue?

I've had an individual give me a "zero" rating for an ad that never resulted in a transaction, or even a discussion of a transaction (I used the ad to try to get in contact with him, after e-mail and AM messages failed). To be completely clear, we did have a different transaction that went pretty poorly - in fact Herb was nice enough to get involved to help resolve it, and I don't mind that he rated that deal. I just do not like being rated for a transaction that never took place. I sent him a AM Private Message and asked him to remove it......no response so far (which seems to be the normal practice with this guy).

What is the correct way to approach this?

If someone rated you for a transaction that never occurred, contact Herb York for assistance. It is against the TOS to do this and he will take the appropriate action (i.e. remove the rating, ban the user, etc).

Well, the issue is now resolved - unfortunately it required Herb's intervention to clarify the TOS - but that part is over. However, now he is turning me over the authorities - a quote from his e-mail to me this afternoon:

"I will file the appropriate complaints with the Missouri Attorney General regarding your criminal misuse of my mail server and my email address under Missouri Law"

This action caused by the fact that I sent him an e-mail after he removed the rating saying only "Thank You!". I'm not going to lose any sleep over this, but I am glad this is over (I hope) - a most unpleasant experience!
