Is it a violation of the TOS?

Can a seller use someone else's pictures without their permission to sell their telescope? If it isn't a violation of the TOS, it should be. Specially if the pics are 5 month old, the scope shipped to Germany and being sold for $1000.00 more. It would be common decency to at least ask permission to use the pictures... Doesn't surprise me at all.

In several places, the TOS forbids use of copy righted material unless one owns the copyright.

Were they photos of the telescope in question?

Was it copyrighted material?

By my reading "yes" it is infringement unless the poster has received permission from the photo owner.
