This may be subtle, but bear with me - I disagree with all sorts of opinions Ruth Bader Ginsberg wrote over her long career, so I arguably disagree with her legal bias.  I have never and I would never accuse her of political bias.  i.e. bending the law to her political point of view.

Rod makes these accusations all the time.  He slanders Clarence Thomas on a near daily basis and it is wrong, unseemly, and ignorant.  Rod does not just disagree with Thomas as a matter of law.  Rod goes further and accuses him of political bias and unethical behaviors.   I sincerely hope that everyone understands this distinction.  Jim
I do not slander Thomas and nor is it slander by citing the propublica articles exposing his ethical issues. Frankly, I think you ought to open your eyes and listen to the various accounts from senator Whitehouse on the doings of Clarence Thomas:

https://www.youtube.com/watch?v=GCqeNGMPtAI

And Clarence gives no indication he will recuse himself from Trump's election interference case despite his wife's efforts to overthrow the results of the free and fair 2020 presidential election:

https://www.cnbc.com/2023/12/18/clarence-thomas-finances-under-scrutiny-as-supreme-court-weighs-trump-case.html

I didn't make up the stuff about Thomas claiming he was going RVing in Walmart parking lots while he's was jet setting on the dime of wealthy conservative donors or getting free tires and batteries for his vehicle, either. And, I don't see other SCOTUS judges advocating for cases to be brought before them so they can be "revisited", either.

I don't understand why you apparently don't see a problem with Thomas in all of the above...

Also, since you think Thomas ought to recuse himself because of his wife's politics, I presume that you think Biden should step down because his only living son is guilty of many criminal acts?

If Thomas's rich friend (or a business he controls) ever has a case before the Supreme Court, I would expect Thomas to recuse himself.   You on the other hand expect recusal from any case that has politically conservative ramifications.  This is a standard you do not apply to the liberals on the Court.  Jim
There's an obvious reason why John Eastment and Kenneth Cheseboro wanted to do the following:

"Trump’s Lawyers Reportedly Wanted Clarence Thomas To Help Overturn 2020 Election, Emails Show"

"Trump’s legal team wanted Supreme Court Justice Clarence Thomas to rule on their lawsuits challenging the 2020 election because they believed he would be their “only chance” at a ruling that could overturn the results, emails reported by Politico show, as Thomas has already come under fire for participating in election-related cases as his wife supported efforts to challenge the vote count."

"Trump’s attorneys should frame a lawsuit over Georgia’s election result “so that Thomas could be the one to issue” an order “saying Georgia is in legitimate doubt,” Trump attorney Kenneth Cheseboro wrote in an email on December 31, 2020, Politico reports."

"Trump attorney John Eastman responded, “I think I agree with this,” Politico reports, adding such a ruling by Thomas could “kick the Georgia legislature into gear” and persuade them to overturn the results—noting he received messages from legislators “indicating to me they’re leaning that way.”"

There's also an obvious reason distinguishing the case of Ginni Thomas, whom Clarence describes as his best friend and confidant, in addition to being his wife, and her protracted efforts to encourage Mark Meadows, Trump's Chief of staff, as well as other legislators, to overturn the results of the election.  In fact, Ginni fervently believes to this day, without evidence, that the 2020 presidential election was somehow "stolen."

Biden, on the other hand, has acknowledged the sins of his son, particularly the addictions, but isn't responsible for them. The house GOP has failed to disclose any evidence linking Biden with any wrongdoing as has been noted by their own witnesses and by prominent GOP senators.
And of course Biden is not a judge so he's not in a position to recuse himself at a trial...

Colorado SCOTUS Kicks Trump Off Ballot

"In a major legal blow to Trump, the court affirmed he engaged in insurrection by inflaming his supporters with false claims of election fraud and directing them to the Capitol — preventing him from a second White House term under the 14th Amendment’s “insurrection clause.”
https://thehill.com/regulation/court-battles/4368569-trump-kicked-off-colorado-ballot-in-14th-amendment-case/

Of course, Trump's people at SCOTUS, starting with Gini Thomas, oops, I mean her husband, Clarence, will quickly hear and overturn the case. Clarence probably has his reason already stamped on his forehead and he will simply email, fax or phone it in or have one his lackeys on his staff do it or they'll all go on speakerphone and sing it like a holiday carol...

Predicting How Scotus Will Decide Trump's Colorado Ballot Case

Posted By Rod Kaufman

While I've pretty much opinionated the cons on the court will do their usual and customary legal gymnastics to bail out Trump, here's the take of Jeffrey Abramson who is professor emeritus of government and law at the University of Texas at Austin and a former assistant district attorney in Middlesex County:
https://www.bostonglobe.com/2023/12/20/opinion/colorado-supreme-court-ruling-trump-14th-amendment/
Seems like the cons will romp on procedural contexts and so-called "due process" issues while disregarding the substance and substantiation of the majority opinion of the Colorado supreme court.

Of course, but that's not my point in posting this. I posted this in order to counter the outrage narrative on MAGA medias that makes it appear that everybody thinks this is a bogus  and politically motivated decision by the court...

1.  Judges have legal/philosophical biases - to the extent "bias" is a loaded word, it would be better to say that judges have core legal philosophies.  Some judges have legal philosophies that are aligned with conservative political thought, like a rather strict adherence to the words of the Constitution, and strict enforcement of the separation of powers.   This is why a Judge with a "conservative" legal philosophy  would oppose Roe v. Wade - it is an example of the Court taking over the job of the legislature, since there is no authority expressly in the Constitution for the Court determining health care.   On the other hand, Some Judges have liberal legal philosophies.  These justices might be less concerned about the literal words of the Constitution or the intent of long-dead framers.   A Judge with a liberal judicial philosophy would interpret the Constitution in the context of the needs of modern society - so a liberal Judge would favor Roe v. Wade because the law had been developing for a long time in the direction of a woman's right to choose being legally superior to the state's right to regulate abortion, but only earlier in pregnancy.

2.  In my view there is nothing wrong or immoral with either judicial philosophy.  Both schools of thought are defensible.  Richard obviously thinks that liberal judicial philosophies are invalid, corrupt, and unequivocally illegitimate.   He is wrong.  Anyone who thinks great legal minds like RGB, Warren, or now Justice Brown-Jackson held/hold judicial philosophies that are invalid, corrupt, and unequivocally illegitimate is just being foolish.   These are brilliant Justices with great minds and long careers.  I have accused you of the same fallacy with respect to conservative judicial philosophies - at least when you argue that Thomas's decisions are invalid, corrupt, and unequivocally illegitimate.  To my knowledge, Thomas has never made a decision that was inconsistent with his core judicial philosophy.  Politics have nothing to do with it.

3.  I wish the Court would adopt a stronger ethics code, but I do not think Thomas needs to recuse himself from an election case because his wife is an activist.  If his rich friends have a case before the Court, he must recuse himself.   Sotomayor should think about this too.

4.  Justices have political biases too - but I do not think you can cite an example of a modern Supreme Court Justice rendering a decision that contradicts their core judicial philosophy because of political bias.

5.  It aggravates me when people like the MAGA crowd you cited argue that the CO Supreme Court acted out of clear and obvious political bias to render as you put it well, "a bogus  and politically motivated decision"  This instance obviously aggravates you too.

6.  If the US Supreme Court overturns the CO Supreme Court, I will bet everything I own that the left will argue loud and stridently that this was a "a bogus  and politically motivated decision"  Are you going to be joining the left in that argument?  On what basis?  I think you will join in with the "bogus  and politically motivated decision" crowd, and that aggravates me too.

7.  Here is the point - I think it is BS, to argue that any of these decisions are "bogus  and politically motivated."   The justices on both courts have a great deal of integrity.  These are close cases where both sides have defensible arguments.  The different decisions (assuming The Supremes overturn Colorado) are the result of different judicial philosophies, not some overt political bias in either case.

That's about the best I can do on this issue.  Have a happy holiday! - Jim
Jim,

Thanks for your erudite and splendid explanation(s) from your perspective; it certainly is fair and balanced, to say the least.
I do have a response to a few of your points:

"at least when you argue that Thomas's decisions are invalid, corrupt, and unequivocally illegitimate.  To my knowledge, Thomas has never made a decision that was inconsistent with his core judicial philosophy.  Politics have nothing to do with it."

That's quite broad in scope but, given Thomas' record, one can generally predict how he'll vote on a case so, even if his decisions are all devoid of the above, his personal biases appear to be reflected in a consistent, and again, a predictable manner.  That, and the fact that he advocates for cases to be brought before him should give one pause. The latter characteristics has obviously caught the favor of wealthy conservative benefactors who have lavishly demonstrated their appreciation for his work on the court hence the glaring need for enforceable ethics for SCOTUS.

" I think you will join in with the "bogus  and politically motivated decision" crowd, and that aggravates me too. "

Well, that's a possibility but I think you might give me the benefit of the doubt until I (we) read the opinion of the court.  The court could conceivably overturn Colorado's decision based upon procedural nuances that have been battered about by legal pundits, ie "lack of due process" / "insufficient procedural requirements in Colorado's jurisdiction"  and the like. Whatever the reasons for an adverse ruling overturning Colorado though, I expect MAGA media to heap praise and glory upon the decision, thereby justifying everything Trump says and does. Afterall, it was decided by SCOTUS!

That said, I wish you, your family and all the AM dudes, happy holidays!

"Over Half Of Americans Approve Of Colorado Ruling"

Posted By Rod Kaufman

"Over half of Americans approve of a Colorado Supreme Court ruling to bar former President Trump from the state’s primary ballot, citing the 14th Amendment, according to a YouGov poll released Wednesday."

"The online survey, published just a day after the ruling, found that 54 percent of respondents either strongly or somewhat approve of the decision, with 35 percent disapproving."

"A plurality, 43 percent, expect the case to be overturned, while just 23 percent believe it will be upheld. Just a third of Democrats said they believe the Supreme Court will keep Trump off the ballot."
