Supreme Court orders Trump administration not to deport Venezuelans under Alien Enemies Act for now

WASHINGTON — The Supreme Court in the early hours of Saturday told the Trump administration not to take any action to deport Venezuelan men based in Texas it alleges are gang members.

In a statement, Lee Gelernt, the lead ACLU attorney in the case, praised the Supreme Court's decision, saying, “These men were in imminent danger of spending their lives in a horrific foreign prison without ever having had a chance to go to court. We are relieved that the Supreme Court has not permitted the administration to whisk them away the way others were just last month.”
Of course, Alito and Thomas dissented. They'd decide to invalidate the emancipation proclamation if they could...

Looks like we all missed the boat on this one, Brian. According to GOP senate majority whip, RON EMMER (R MINN), the deported immigrant in question HAD DUE PROCESS!

To Wit:

“Actually, I think he was afforded that due process,” Emmer replied. “In this case, an illegal alien was transported back to El Salvador. The administration initially thought it was a mistake. Subsequently, it said it was not a mistake.”

"Bash again pressed the Minnesota Republican about what he meant by due process for Abrego Garcia, and if he meant the 2019 hearing that granted him the ability to stay in the U.S."

“I’m talking about when he requested asylum and it was rejected. I’m talking about that hearing, which I’m not going to get into the transcript,” Emmer said, later adding, “He had due process. It was rejected.”

"Part of Abrego Garcia’s 2019 agreement was to shield him from violence in El Salvador. Bash noted that he had a protection order not to be deported specifically to El Salvador."

"Emmer dodged Bash’s comments and said he found it interesting that Van Hollen and CNN are “doubling down on an illegal alien” and not supporting constituents who are harmed by migrants."

There you have it, "Due Process", Republican style!....

"It is such a no brainer, the only conclusion is it is an intentional plan to extend Executive authority."

Well, that's a given considering the actions of the Trump administration.

"Which is fine, if they respect the new boundaries set by the Court (or Congress). "

They have shown no inclination to do so and have repeatedly thumbed their noses at congress and the courts. That much is obvious.

PS: I really enjoyed seeing your truly awesome image of the sun on the AM picture of the day. The only thing that irks me is when the posters don't include a description of the scope used to take the image. There just seems to me to be a gross oversight when that happens in that the scope is fundamental in what we do.smile

SCOTUS judge Samuel Alito and his RIGHTEOUS INDIGNATION specifies his outrage, not at the Trump administration for what it did, but at the majority opinion of SCOTUS for what it did!

“Literally in the middle of the night, the court issued unprecedented and legally questionable relief without giving the lower courts a chance to rule, without hearing from the opposing party, within eight hours of receiving the application, with dubious factual support for its order, and without providing any explanation for its order,” Alito wrote in a dissent that was joined by Justice Clarence Thomas."

Yup, only the Trump administration can, literally in the middle of the night, conduct unprecedented and legally questionable deportations without waiting on lower court rulings or, has been the case, ignoring them without explanation...

The objective is filtered initially with a full aperture Baader CERF energy rejection filter, that I bought used here ages ago.  The camera is a non-cooled ZWO ASI294 that has a big enough chip to capture the entire output of the solar filter after I run it through a Baader solar telecompressor.  There is some vignetting, ezpecially on the close ups.

Capture is with freeware Firecapture, stacking of the best 20% of 5000 frames is with freeware AutoStackert.  Wavelet sharpening with freeware Registax.   I take a balanced shot of the disk and a overexposed shot of the proms.  These are combined in Photoshop such that the disk is inverted and the proms are not.  This gives me a black sky and white proms with matching white filaments that I like a lot.
OK! (Er, ah, whatever you do, just keep doing it!)

In other news:   "Hegseth Shared Yemen Attack Plans With Wife, Brother in Second Signal Chat"

'Defense Secretary Pete Hegseth apparently shared “detailed information” about the bombings in Yemen with a second group chat on Signal that included his wife, brother, and lawyer, the New York Times reported Sunday."

"The information shared included “the flight schedules for the F/A-18 Hornets targeting the Houthis in Yemen”

"Hegseth’s wife Jennifer is a former Fox News producer who has been criticized for attending sensitive meetings alongside her husband. His brother Phil Hegseth and lawyer Tim Parlatore work at the Pentagon."

"He used his private phone, rather than his government one, to access the Signal chat.”

"Supreme Court to hear challenge to Trump's birthright citizenship order in May"

"To date, every court to have considered Trump's executive order banning birth right citizenship, issued on day one of his administration, has blocked it. But he has doggedly persisted in his contention that birthright citizenship is unconstitutional, an idea widely considered a fringe view because the Supreme Court ruled to the contrary 127 years ago, and that decision has never been disturbed."

"For over a century, it has been the settled view of this court, Congress, the Executive Branch, and legal scholars that the Fourteenth Amendment Citizenship clause guarantees citizenship to babies born in the United States, regardless of their parents' citizenship, allegiance, domicile, immigration status or nationality."

"Federal district court judges in three different states have forcefully rejected that view and blocked Trump's executive order voiding birthright citizenship. And three separate appeals courts have refused to unblock those court orders. Judge John Coughenour, a Reagan appointee in Washington state, was the first judge to block Trump's executive order, calling it "blatantly unconstitutional."

RFK jr's Measles Doctor Has The Measles

Posted By Rod Kaufman

As if RFK Jr doesn't have enough power, here comes SCOTUS, likely to grant him more, if it doesn't simply remove preventative health care from being covered in the first place:

RFK jr's Measles Doctor Has The Measles

Posted By Rod Kaufman

"Video shows doctor with measles treating kids. RFK Jr later praised him as an ‘extraordinary’ healer"

"Dr Edwards  is asked whether he had measles, and he responded, “Yes,” then said his infection started the day before the video was recorded."

“Yesterday was pretty achy. Little mild fever. Spots came in the afternoon."

"Measles is most contagious for about four days before and four days after the rash appears and is one of the world’s most contagious diseases, according to the U.S. Centers for Disease Control and Prevention. Doctors and public health experts said Edwards’ decision to go into the clinic put children, their parents and their community at risk because he could have spread it to others. They said there was no scenario in which Edwards’ conduct would be reasonable."

"Even as measles has exploded in Texas and spread across the country, Kennedy, the nation’s top health official, has declined to consistently and forcefully encourage people to vaccinate their children and remind them that the vaccine is safe. Kennedy’s post drawing attention to Edwards is inappropriate but unsurprising given Kennedy’s record, said Dr. Craig Spencer, a medical doctor who is also a professor at the Brown University School of Public Health."

"Trump Jr.: Former Hegseth aide who described ‘chaos’ now ‘exiled’ from MAGA movement"

Posted By Rod Kaufman

What!? A Republican actually has the stones to speak up on Hegseth?

"Rep. Don Bacon (R-Neb.) stopped just short of calling on Defense Secretary Pete Hegseth to be removed Monday following a new report that alleges the secretary shared detailed military plans in a group chat that included his wife, brother and personal lawyer."

“If it’s true that he had another [Signal] chat with his family about the missions against the Houthis, it’s totally unacceptable,” Bacon told Politico, adding, “I’m not in the White House, and I’m not going to tell the White House how to manage this … but I find it unacceptable, and I wouldn’t tolerate it if I was in charge.”
