Hi Rich:

I'm confident in my position.  If Trump makes the executive order, I'll bet you a dozen doughnuts to one that the Supremes ultimately declare the executive order unconstitutional under the 14th Amendment.  Maybe we'll see, I doubt it though.  I think that Trump's advisers have or will convinced him that this executive order is constitutionally DOA.

This raises an interesting political side question.  I'll concede that if Trump makes the executive order he personally believes that it will stand up.  Then we can make the 12:1 doughnut bet.  But... let's say that Trump never makes the executive order.  Do you personally think (in your opinion of course) that this signals:  (A) Trump actually believes that the executive order is unconstitutional, or (B)  Trump is now in favor of birthright citizenship, or (C) something else?

Illegal aliens are subject to the partial jurisdiction of the US, but not the complete jurisdiction.

This fact is brought up regularly by Constitutional Scholars, those like John Eastman, Mark Levin, Daniel Horowitz and many others like Andrew McCarthy.

And you can make your little snide remarks about me above, but here is something for your edification:

You might want to read it and learn something aside from what you are so cocksure about.

And I'm partisan about one thing, that is for sure, and its called the US Constitution.

I think with all the patent work you've done in your life, you've forgotten a good deal about it.
Like I said, I'm keenly aware of the arguments opposing my position.  Please don't forget to reply to my post above, the one with the 12:1 doughnut bet.  Speaking of doughnuts, remember these?  I like to break this out now and then, just to keep you on a good diet.

p.s. McCarthy and Eastman disagree with me on the scope of the 14th Amendment, but they agree that the current recognition of birthright citizenship can not be changed by executive order.

Colorado's system of mail in ballots.  Of course, if you are a procrastinator you can also drop off your ballot on election day.  We also have nifty tracking software that let's you know when your ballot is scanned at the post office and received by the election commission.  Very high tech.

I wonder if our 100% mail in/drop off system affects turnout one way or the other.  I would think it would have to bump up overall turnout, but it might not do so evenly across all demographics.  Our young adult kids had to come back to the homestead for example to get their ballots - it's nice to see them though.

Hi Maurice:

Too true!  My guess is that the D's hold a thin 5-10 seat majority in the house after today, but the R's hold the Senate and pick up one or two seats.  I see that you are in Alabama now...   Didn't you retire to a dark-sky site in western Australia a few years back?

Hi Darian:

1. Polling data - I know that the pollsters blew it in 2016, but maybe they have adjusted their models?  Maybe not.
2. History - It seems like the president's party always suffers a setback two years after their election.  I think this is the system re-calibrating, and is generally a good thing.  It certainly was a good thing in 2010 for example.
3.  Motivation - The D's often under perform in mid-terms because the youth becomes disengaged when the presidency is not on the line.  I think that Trump's personality will  keep the youth and some other casual D voters engaged.  It seems that turnout is very high in the early voting.

Of course, I'm probably wrong!  We'll see.

The bloodbath begins...

Colorado is definitely blue.  According to the New York Times our governor elect will be "the most progressive governor in the nation."  Thanks goodness we have what we call locally the TABOR amendment (Tax Payers Bill of Rights).  It was passed years ago and requires a vote of the people to raise taxes and do many other things.  It has long served to keep the spendy politicians in check... or to assure that our schools and infrastructure are grossly underfunded.  It depends upon who one talks to!

Anyway, it is kind of odd that Colorado is going whole-hog blue this election cycle and the last one too, but most all of the ballot initiative to raise taxes are going down in flames.  I think that means that the average Coloradan is a fiscal conservative, who likes Democrats.  Go figure.

I will be peeved if Trump has an "I have a pen and I have a phone" moment though.

Trump's financial advisor, Kudlow, has one thing going for him. He's been wrong in every financial prediction he's ever made. The one with China, a major factor in the market meltdown, continues to suck for everyone.
I hope I don't have to post Obama got us out of a recession while Trump got us into one but time will tell. Oh, and nobody got indicted in Obama's administration, either...
Hi Rod:

The image below is the DJIA over the entire Obama and Trump administrations.  Could it be that the market is driven by forces bigger than the chap who sits in the Oval Office?

Speaking of being spectacularly wrong, I'm sure glad I did not sell in 11/20116 when you and Mr. wrong himself, Paul Krugman, predicted an epic collapse!  Remember that?  https://www.nytimes.com/interactive/projects/cp/opinion/election-night-2016/paul-krugman-the-economic-fallout

"It really does now look like President Donald J. Trump, and markets are plunging. When might we expect them to recover?  Frankly, I find it hard to care much, even though this is my specialty. The disaster for America and the world has so many aspects that the economic ramifications are way down my list of things to fear.

Still, I guess people want an answer: If the question is when markets will recover, a first-pass answer is never."

Ouch.
