Shocking!: Another SCOTUS Victory For Trump!

Posted By Rod Kaufman

"The Supreme Court on Friday allowed President Trump's administration to withhold more than $4 billion in foreign aid funding, granting its request for emergency relief in a dispute over money that Congress has already approved."

"The high court's decision follows an order that Chief Justice John Roberts had issued earlier this month, which temporarily froze a district court injunction requiring the Trump administration to spend the money Congress appropriated for foreign-aid projects by the end of September. The court appeared to divide 6-3, with Justices Elena Kagan, Sonia Sotomayor and Ketanji Brown Jackson, the court's three liberals, dissenting."

Jim, I don't know how this could be given that they're actually going to have oral arguments instead of deciding it clandestinely in the shadow docket!shocked

Jim, upon reflection,  I'll take a stab at it:

My guess as to why hell has seemingly frozen over and SCOTUS is actually going to have oral arguments instead of expediting a favorable shadow docket decision yet again for Trump is:

1. Clarence was either yachting, RVing, boating or in transit via private jet to his favorite private island.

2. Amy was home with the kids and/or giving a presentation at a local prep school for girls on a  handmaid's  tale.

3. Sammy called in sick that day.

4. Neil slept in late after losing his voice pontificating on the virtues of conservatism.

5. John was posing for his portrait in the upcoming Trump ballroom.

6. Brett was home with his security detail deciding which October beer fest he should go to.

So, one of the remaining SCOTUS judges made the call under strict orders from John not to decide anything on the shadow docket without hearing oral arguments first!

I'd like Jim Brown's take on the "why" behind this CNN explanation of the "how" SCOTUS does what it does with the shadow docket:   https://www.cnn.com/2025/10/02/politics/video/shadow-docket-trump-supreme-court-explained

The tables above have really nice click through links.   Try a few in your favorite hot-potato politically charged cases and see how often you see language in the order along the lines of:  “stayed” or “granted” “pending disposition in the court below, or further action by this Court.”
Jim,
I don't think the nicely-starched robe attire you've described in your initial response holds up under scrutiny. For example, the Biden administration sought clarification on a timely affordable care act issue from the emergency/shadow docket and was refused. The Trump administration later posed the same question and it received an immediate response and review by the docket. So, it appears that the politically conservative element of the court determines what is heard and what is not by their biases and not necessarily by the process that you've described.

Additionally, as noted by a lower court judge in that CNN video, the court is not providing the guidance that it should to the lower courts in its lack of explanations for their shadow docket rulings and, in essence, alternately either refers to them as de facto precedents and/or determinations that can't somehow be provided in writing because a final determination hasn't been made by SCOTUS. Since there's no clarification by SCOTUS on this self-created problem, it appears to be a major contradictory issue on their part, or perhaps a major error of omission due to apparent judicial incompetence.

To simply say, on your part, that's it's the fault of democrats not winning more elections to influence the makeup of the court seems unreasonable and untenable in light of the above.

That low standard of entry you refer to is apparently low for one administration and high for another given that example cited of the same issue being denied for a hearing from the Biden administration while being expedited for the Trump administration.

It'll be interesting to see what SCOTUS does with the birthright citizenship issue now that an appeals court, like those preceding it, has unanimously ruled that the birthright citizenship is constitutional. Frankly, I don't understand why SCOTUS is going to hear it in the first place. If they find to the contrary or even if one or two do, it shows how far off the mark from the constitution some of them on the court actually are in their thinking...

The orders issued on the emergency docket have rarely been detailed orders for all of history.   Also, they are not typically precedent.  Usually the Court grants or denies a stay of a lower court ruling, an injunction for example, while the litigation proceeds.   Did you guys look at those tables, and click on the links?   Did you see all the referrals back for further proceedings?

Here is an interesting aside.  Did you notice all the death penalty cases on the emergency docket?  I did not look at them all, but it appears that these are routinely denied by the Roberts Court.  For better or worse it was not always that way.   This is a good example of the Court’s philosophy trending from left to right based upon the makeup of the Court.

Rod, I know that I’ll never convince you, but you are simply dead wrong when you find incompetence or malfeasance in each of the  Court’s ”disappointing” rulings, when viewed from your liberal perspective.  Any pundit who writes any article whatsoever equating a conservative Court with “wrong” or “incompetent” is just a political hack and probably knows they are lying.   It is not right v. wrong thing, it is conservative judicial philosophy v liberal judicial philosophy thing.   The death penalty cases show this.  Roe showed this.  Smart people like RBG knew this.   Guest editorialist who used to be in the DOJ, or who used to be judges know this too.  You won’t catch them saying it on CNN though.

Jim, as I had noted in my post, I was referencing the lower court judge who complained about the lack of direction and guidance from SCOTUS in their generally unexplained shadow docket decisions along with their statements of de-facto like precedents on the one hand and their apparent denials of this on the other. THAT does not seem like judicial competence, does it?

If the litigants desire a fully detailed legal opinion, fully resolving all issues, they must proceed on the normal docket after grinding through the lower courts.

Even though I do not think over-use the emergency docket is an existential threat to democracy, that does not mean I think the current situation is good. The emergency docket is being over - used.   I’m happy to  apportion blame between Trump and his extremely zealous and litigious opponents, as I mentioned in my reply to James above
We can go back and forth on the de facto precedent being presented by some of these cases and their denials of such precedents over and over again and the lack of guidance provided by SCOTUS to the lower courts that the precedent-like docket rulings entail but I'll cite another example of what is judicial incompetence and that is Clarence Thomas' second amendment historical standard crap-decision that has confused and confounded the lower courts deciding gun laws again and again. And the relatively recent feeble attempt by Roberts and the court to clean up Thomas' mess is just that.

"Justice Clarence Thomas's historical standard for interpreting gun laws, established in the 2022 New York State Rifle & Pistol Association v. Bruen decision, is confusing lower courts across the country. The new "text, history, and tradition" test requires judges to assess modern gun regulations based on whether they are consistent with historical analogs from the 18th and 19th centuries. This has led to conflicting outcomes as judges struggle with several key issues." AI

My job enacted a return-to-office policy that was impossible for me to honor, and at about the same time, they offered a generous voluntary severance plan. I requested an exception to continue working from home, but the VSP offer would expire before they could determine if the exception would be granted. So, I took the VSP, and haven't regretted it, other than the whole healthcare issue. I wonder how much of that will be weaponized and used against me, at some later date? Haha.

My daughter is a software engineer/developer, too.

Sorry to hear about the situation with your wife and I understand the health insurance issue can be difficult so I hope it works out for both of you.

In the meantime, I have to do something else, and, aside from finding another job, which is not possible, my only option at my age is to enroll in ACA. You can't even do "catastrophic" policies anymore at my age. In Texas, and I'm sure it's similar elsewhere, you must be 30 years of age or younger to qualify for a catastrophic policy. Exceptions can be made, but you have to be destitute to qualify, which is not my case, and I wouldn't want it to be either. From what I can tell, the system is designed to push everyone who cannot obtain insurance through their private employer and who is not eligible for Medicare onto the ACA. It makes sense because you want everyone to be in the risk pool, but at the same time, the ACA is not affordable for way too many people. The enhanced premium tax credits for the ACA helped significantly with affordability, but if they don't extend those, a large number of people will lose health insurance because they can't afford it. Estimates indicate that 5 million people will lose coverage entirely, and 8 million will have to pay the full premium cost, which is at least $1,000/month for a single person. And that's just for the privilege of having the insurance. If you want to access healthcare, you will be paying significantly more out of pocket because deductibles range from $10,000/year and up. I can afford the premium, and I'll have to pay it, whatever it turns out to be, but this is what they mean when they say our healthcare system is seriously broken and dysfunctional when it comes to providing affordable healthcare. I know several people who intend to go uninsured if the enhanced premium tax credits are not extended into 2026, and even some individuals who are currently uninsured because they can't afford it.
The GOP stance on the govt shutdown and why they won't include the ACA premium credits in the current funding bill is because funding from the ACA goes to illegal immigrants.

"Based on recent fact checks and current law, the GOP claim that benefits from the Affordable Care Act (ACA) go to "illegal immigrants" is false. Undocumented immigrants are explicitly barred from eligibility for federally funded health coverage programs like the ACA Marketplace, Medicaid, and Medicare." AI

And yet the GOP powers that be want the Democrats to negotiate with them to end the govt shutdown on good faith even though they lie about the ACA from the getgo!
