I agree that it is a war, an existential one imposed by an enemy following a book that tells them not to stop until there are no remaining non-believers in the world. A clear policy of harsh consequences to non-uniformed terrorists and any domestic enablers is warranted.

I do not agree on "by any means necessary". Years ago, I read Alistair Cooke's "A Savage War of Peace: Algeria" about the Algerian War. Highly recommended if you are interested in the history of that brutal war and how it was a precursor to modern islamic revolutionary tactics and terrorism. One thing that history made clear was how systematic torture, even against the most savage terrorists imaginable, had a huge impact in eroding the French war effort and led to their withdrawal even after military victory. Torture made the enemy more determined, more numerous, more savage. Torture gave credibility to the enemy and garnered foreign support for them. Torture ruined what moral high ground France had. Torture was used by the leftist press and celebrities in France to turn public opinion against the war (sound familiar?). Torture killed support for France from international allies, including the U.S. It is quite possible that without France's systemic torture, they would have stayed in Algeria and it might not have spent the next 50 years embroiled in brutal islamic civil-wars and exporting terrorism. Nobody knows what would have happened, but it could have been very different.

That doesn't answer the question of what you do if you catch a terrorist that you think knows the details of an imminent attack on the Super Bowl. What one agent quietly does to violate official policy in the heat of battle is one thing. But a systemic torture policy grows on it's own, and lets you make justifications to torture anyone who might lead you to him because you must catch him. His girlfriend? The imam at the mosque he prayed at? They guy who made him the fake passport? The family that put him up in secret? Pretty soon you have turned the world against you and escalated the war.

Phony as it was, these two guys in France were motivated into extremism by exaggerated stories in the leftist press about perceived U.S. torture in Abu Ghraib. You can't even have idiot prison guards, your lowest level of military posting for those who can't, left unsupervised long enough to do some goofy hazing of prisoners, because people will inevitably die from the perception of your country as evil.
