Totalitarian Threats by Totalitarian President Biden MUST Be Ignored.

Hi Greg and Rich:

Brett Kavanaugh inadvertently gave Biden some cover.  Kavanaugh joined with the liberal wing in June to let the previous eviction order stand until it expired at the end of July.  He did this, even though he agreed with the conservative wing that the original orders exceeded the CDC's authority.  I don't think that Kavanaugh will be pleased that Biden and the CDC have baited and switched him - so the new order will be dead on arrival the instant a Federal Court touches it and the Supremes will not be accommodating this time around.

But technically, the new order does not violate SC precedent, because of Kavanaugh's earlier attempt to be reasonable.  Also, the new CDC rules have a "hand-wavey" distinction of only being applicable in places where Covid is on the rise.  So Biden can argue that this new rule is different enough to be constitutional.  He'll lose, but he does have that cover.

Kavanaugh's one-page concurrence from June is here:   https://www.supremecourt.gov/opinions/20pdf/20a169_4f15.pdf

In my own opinion, it is not properly impeachable for Biden to issue a new but subtly different order he believes is doomed.  The new CDC order is not technically violating any express Federal Court injunction, and the new order is "different."  Those are the arguments anyway.

FWIW, no one will be prosecuted under this new order, and it is doomed as soon as today.  I suspect that the lawsuits are being filed on behalf of property owners as we speak.

Bottom line; Biden caved to the D left wing.  It was a political calculus that he may regret.  This sort of move may cost him in the long run with an already predominantly hostile Supreme Court.

I understand your point Richard.  I personally think it only becomes totalitarianism if/when the CDC enforces the moratorium and jails someone after the Supreme Court strikes this down, once and for all.  At that point we take to the streets.

Until then, I think we recognize this for what it is - an ineffectual bone thrown by Biden to those in his party clamoring on the left.  Only an idiot like Maxine Waters thinks this is a good move.  I think Biden made a tactical mistake, but the context here is US political manipulations, not a totalitarian take over.

Here is a thought - call it "Jim in the defense of Biden 1.0."

If you read Kavanaugh's one page opinion linked above, he mentioned that the CDC does not have this authority until congress expressly gives the CDC this authority.  How could that ever happen?  Obviously by dispensing with the filibuster which is something those yapping to Biden's left have been demanding for a long time.

Maybe Biden is throwing the left this bone to avoid additional pressure being brought against the Senate to eliminate the filibuster?

Don't get me wrong, Rod - I think this was a bad move by Biden.

(A) it is doomed and ineffectual.
(B) it will piss off Kavanaugh and Roberts, possibly solidifying them against him.
(C) this sort of government overreach will play poorly in the midterms and in 24.

Any speculation by me that Biden is playing a larger game is just that - speculation.  About the only place I disagree with Greg and Richard on this issue is whether it should be grounds for impeachment or whether it is a totalitarian act.

Of course, one thing the House D's accomplished during Trump's presidency is making impeachment into a mere public censure of little or no weight.

Hi Greg:

The punchline delivered by your hypothetical hero is profoundly flawed.

We all expect others to keep us safe.  I don't think this can be denied, unless one is a hermit living in the woods completely detached from society.  On the highway for example, we all expect our fellow drivers to be sober.  We lock them up in jail if they refuse to comply.  We do that to protect innocent third parties, not to protect the drunks.  We all expect lawful gunowners to use their guns in a lawful and safe manner.  You know what we do, if they refuse.  We expect our tradesmen to build to code.  We expect our restaurant cooks to comply with the health regs.

And so on - I think one could argue that a key reason societies evolved is because we all work together to keep each other safe, which is the same as saying part of the social agreement is that we expect others to abide by rules to keep us safe.  I'm happy we have an army, a police force, first responders and so on - because they keep me safe.

Personal liberty is something I cherish, but personal liberty has its limits too - and public safety is at the foundation of many of those limits.  I can think of countless examples where public safety trumps my personal liberty.  Requiring kids to be vaccinated against childhood diseases if they attend public school is one point where public safety trumps personal liberty that I have no problem with.

I dont expect you to come running if I am attacked, I will allow that you MIGHT but I certainly wouldnt bet my life on it. I am perfectly content with being responsible for my own safety. Now if being prepared to protect myself affords me the chance to protect someone else then great, I am happy to do so. Laws and wishful thinking mean little in the moment.....so you really arent making a valid point. Laws and police etc are about dealing with the aftermath and have little to do with the moment.
Greg - If you want to limit the discussion to armed personal defense with handguns, then maybe your point is logical.  I too would not expect a fellow citizen to come to my aid in an armed robbery for instance.  But why is this extremely limited example relevant to broader issues like masks and vaccinations?  You can't have it both ways.  Either limit your example, and limit its relevance, or let's talk more broadly.

I'm talking about a broader perspective of course.  The universal agreement underlying our society requires us all to be broadly be responsible for each others safety - by following the rules!  We expect this and we count on it.

"Laws and police etc. are about dealing with the aftermath and have little to do with the moment."  This is hogwash.  Laws serve as a deterrent and always have.   For example, I assume you are OK with jailing drunk drivers before they injure a third party??  Or do you really think drunk driving is a choice that an individual should be free to make so long as he is fortunate enough to never to hurt someone?  Other examples like mandatory vaccinations for public school children are a lot more relevant to the masks and vaccination debate than personal defense with sidearms.

The following quote is from 116 years ago, by Justice Harlan upholding the Constitutionality of a mandatory vaccination law:

"in every well ordered society charged with the duty of conserving the safety of its members the rights of the individual in respect of his liberty may at times, under the pressure of great dangers, be subjected to such restraint, to be enforced by reasonable regulations, as the safety of the general public may demand" and that "[r]eal liberty for all could not exist under the operation of a principle which recognizes the right of each individual person to use his own [liberty], whether in respect of his person or his property, regardless of the injury that may be done to others."

This is still the law of the land.

However let me posit this thought and see what you think about it.

It has to do with the Threat made by the Biden Administration to American Citizens who own private property, and that is something that I think is very pertinent.

This administration has 'threatened' (and I don't think I'm using that word loosely here) property owners.

Let me ask you, if you were a property owner minding your own business, paying your taxes, and you were a landlord, would you feel intimidated by the fact that the US gov't has "threatened" you with both Big Jail time AND massive fines that you cannot possibly pay?

Would that threat by the United States government intimidate you enough that you would be literally terrified to evict someone who was essentially squatting on your property?

How would that make you feel?  Would you be scared to death?

Do you think that these threats by the US gov't aren't a big deal?

I can tell you this much, I was a landlord one time with one property I had in Florida, and I ended up evicting the last renter who simply failed to pay the rent for about 4 months straight.

When I did finally evict this tenant, he had destroyed the property.  My friend out there who was a realtor entered the property after finally being able to evict him. It took me a couple of months to get him out.

My friend was a former NY cop and he said that when he entered, he announced himself and drew his service weapon because the place was so bad and there was so much garbage in both the house and garage, that he thought squatters had taken over the place.

I hired a father son team that removed 7 large pickup truck loads of garbage and junk.  Thankfully they were able to get it all out of the place by the time I got there.

Fortunately I'm a remodeler so I ended up renting a car, purchasing tools when I got there and I spent 2 solid months remodeling the place at my expense.

My property management company was a complete joke and lied to me and during the time period they were "watching over" the place, they were submitting fraudulent bills to me telling me that windows were broken that never were, and I got screwed big time.

Luckily when I finished the house, I invited all the neighbors for a viewing and I ended up selling it within 2 days to one of the neighbors and this was when the market was not good.

Had I been in the situation that Biden and the CDC, and these Leftist Democrat Politicians have put private property owners in, these gov't bureaucrats who do not give a damn about the rights of property owners in this nation, I may have ended up losing my house to that scumbag who destroyed it, so I speak from experience.

It would be frightening to be a landlord today, wondering how on Earth you are going to keep up with the bills for the mortgage that is not being paid by the millions of individuals who have now become 'squatters' and are happy that they have the Joe Biden Administration to engage in their thuggery towards citizens who are the landlords in this country.

To them it doesn't matter if their landlords get paid, because they think they are entitled to live there Scot free

And I am honestly not trying to be hyperbolic here when I use the word thuggery to describe what the Biden Administration is doing.

So then I'll end this by asking you if you believe that there are hundreds of thousands of landlords who may have no recourse because they know they just need one judge who has the same mindset as the Biden administration to deny their eviction notice lawsuits, and they only need a few Sheriff's Departments out there who will not enforce the legal eviction notices that they receive in court, to destroy their lives.

When have Democrats EVER considered business owners in this pandemic?? They send out piddly amounts to business owners, then threaten them with jail if they don't abide by their thuggery.

Are you familiar with the New Jersey Atilis Gym situation, where the Governor had a hard on for the owners who refused to buckle under to his thuggery?

That governor went through the courts and fined the owners well over $100,000 and then got a court order to drain their bank account.

What do you think of that?

Thanks for the reply, enjoy your night.  smile
Yikes!  That's a lot to digest Rich and I'm tired... I'm jumping on a plane in the AM.  I'll try to reply in some detail, but it might be a while.  FWIW, I think the Biden/CDC order is threatening to landlords, is bad policy, is unconstitutional and is unenforceable.   I imagine most landlords feel the same.  (Even so, it's not a totalitarian/impeachable act IMO)  I'll be back as soon as I can, could be a while.   Jim

Hi Rich:

I actually enjoyed your "nice Rich" phase.  The "nice Rich" phase ran more or less from the time I called you homophobic and then took it back until now.  (I'd crossed a line and you were righteously pissed.)  We have had a few cordial exchanges since then.  I enjoyed the interaction.

This post of yours here comes across to me as mysogynistic and transphobic.  I suppose that you are not a mysogynist or transphobe in real life, I hope so anyway, but think about how your post reads!  I also understand that you and Rod have a particularly hostile relationship, but still...  Is this sort of post necessary?
