Happy Election Day

Hi James:

Definitely a point worth making.  The same could be said about recent immigrants, when they start voting for Republicans, against conventional wisdom.  If VA proves anything, it proves that the political climate and the politicians themselves matter a lot more than expanded voting opportunities.  Biden is indisputably and predictably a drag on the D party right now, and by all accounts, McAuliffe ran an uninspired campaign terminating in an incredibly stupid series of comments about education.  If I were a D in VA I'd have voted against him too.

As a moderately interesting aside, I think it about time that the "derangement syndrome" taunt be retired, as in William's short "TDS" post, as if that catchphrase meant anything, other than a polarizing taunt.

With respect to the use of "derange" in your reply, I understand that you are using rhetorical symmetry for effect, and it was nicely done.  But at the end of the day, I bet you agree that the political operatives carrying Trump's bogus stolen election message are not deranged.  Rather they are cold, calculating operatives seizing on a bogus message they think will resonate with enough people to make a difference.  In my opinion, not unlike Russian collusion or other bogus messages, known to be bogus when delivered.  Of course, the "other" side, is equally cold, calculating and deceptive when they inevitably argue that the original bogus messaging is an existential threat to the union.  It seems the punditry and political operatives are always at Defcon 1 nowadays.

Some folks buy into these bogus messages and counter messages with gusto and perpetual outrage, I am pretty sure that most voters recognize the bogus messages as amped up politics only.  I hope so anyway.

I'm rambling now, but did you know that political use of the {Name} derangement syndrome taunt probably originated back in '03 with Bush derangement syndrome?  I remember Obama Derangement Syndrome, but did not remember it going back almost 20 years....

The responder was confused.

It appears that the responder above did not understand the 1905 Jacobson case and misconstrued it to believe that the case was giving the Federal Gov't the power to act as a police state in mandating and forcing a vaccine.

He was obviously confused.

I pointed this out in a previous posting, that this case was irrelevant to the idea and actions of Joe Biden forcing a vaccine, and the original responder ignored it.

Today a Federal Judge acted to correct the UnConstitutional Actions of the tyrannical Biden regime.

Here is the article which affirms it:  https://www.theepochtimes.com/mkt_breakingnews/federal-court-blocks-biden-administrations-private-business-covid-19-vaccine-mandate_4089942.html?utm_source=newsnoe&utm_medium=email&utm_campaign=breaking-2021-11-06-2&ktids=57c5b13448d3d96e931e87904b7ce8d8&est=lh6DflSRVlK%2FKjxJFcXIY7OtuBEcbxa7ORkeVLN0SgV94n4Eh8yUQnHTAUEPfiMArs3YTiMfwA%3D%3D

Those who are still confused might want to take note above.
Rich, your original post talked about "democrat politicians."  You said nothing about the distinction between federal and state authority.  I replied accurately.  Now you claim that you were talking about federal authority, not state authority all along.  That is possible, I suppose, but I'm not a mind reader.  An honest man would limit his post to federal action in the first place, if that is what he intended.   Go read your opening post.  Not a hint of federalism in it.  More likely, you have moved the goalposts after the fact to make it look like I was wrong.  Shame on you.  Jim

You can play your little Bullshit games all day long Jim.  I was speaking about the Biden administration specifically, which means the FEDERAL Gov't.

So you're going to pull the James Lacey move are you and feign that you were only speaking about STATE and LOCAL gov'ts are you?

Your initial response to me indicates that your assertion above won't work.

And I just have to remark that you're personally adopting virtually ALL of the leftist tactics that your buddies here use, including your "Moving the goalposts" crap, the leftist words that James Lacey uses in virtually every response to me.  LOL

You're obviously learning well from James Lacey now aren't you?  smile

I wasn't speaking about LOCAL gov'ts or STATE gov'ts, which is why you specifically delineated in your original response this remark from you:

JB:   Do you realize that vaccine mandates were first ruled constitutional and perfectly legal in 1905?
That's 116 years ago, comrade Rich.  The government can also prohibit your kids from attending public school if they are not vaccinated.  Same as it has been virtually forever, under all types of administrations and state and local governments.

Apparently, you would argue that the US has been a totalitarian dictatorship since 1905.  Good luck with that.

You obviously didn't read the ruling or if you did, you hadn't boned up on it, and you were unfamiliar with the ruling.

My guess is that you heard some hack lawyer on CNN bring that up, who was like yourself, Also wrong.

Now you're going to put up your CYA bullshit that you were ONLY speaking about STATE Gov'ts when you brought up the inapplicable, irrelevant Jacobson ruling to counter my posting?

Bullshit.  wink

Your words above indicate that you were speaking about administrations AND state and local gov'ts.  If you weren't speaking about the Federal gov't, you wouldn't have added the words "AND state and local gov'ts" to your statement in order to make a distinction between the Biden Admin and State gov't.

Further, you wouldn't have mentioned The US being a totalitarian dictatorship if you were only speaking about State gov'ts rather than the overall Federal gov't.

I, You, and everyone else with a brain knows what you were saying.

I was complaining about the Biden administration instituting their FEDERAL mandates, and you brought up the irrelevant, inapplicable Jacobson case.

You were confused and I called you on it, simple as that.

Don't try to do a tap dance now.

Its unbecoming of you.   tongue
Ha Ha, good one.  Read your original post.  We both know that the "government"  is a wonderfully effective blend of federal, state and local power.  If you want to make a point about the federal government, say so.  Don't make us guess.  Or don't try to limit your point to the federal government after the fact.  And lose the feigned outrage.  If you were inclined, you and I could probably have a reasonable discussion about the scope of federal v. state authority in health care and how it has grown so much in the last 100 years, and whether that is a good thing.  Reasonable discussions are not your intention though.

It would be very fitting at this point. smile

Let me just reeducate you by informing you that the Jacobson v. Mass. ruling from 1905 that you provided to try and show that the Biden administration has the authority to institute a Vaccine mandate is inapplicable and wrong.

It has no relevance, but nice try.  Perhaps you should have read it before you posted it.   wink

Next.....
Rich, I'll give you the benefit of the doubt, and accept that you intended to limit your initial post to the Federal government.  I certainly did not pick up on that limitation in your original post.  I provided the Jacobson case because it does in fact show that government vaccine mandates are constitutional.  So Jacobson certainly supports the point I was making in response to my understanding of your opening post.  We will have to disagree on whether your opening post clearly makes a point grounded in federalism,  but like I just said, I'll take your word for your intentions.

Moving the ball forward, I have always argued that the federal government lacks Constitutional authority to regulate the state's implementation of their health care policies.  This has been my legal argument against Roe for a long time.  Under my preferred analysis, a federal vaccine mandate covering private citizens would be unconstitutional.  This however, is not an open and shut case by a long shot.  An extreme federalist would argue that the OSHA laws underlying the federal mandate are unconstitutional, and I don't see OSHA being stricken any time soon.

My guess is that the federal mandate is ultimately ruled constitutional in a somewhat tortured opinion written by CJ Roberts.  We'll see.  I personally think it is a shame that mandates are necessary given the demonstrated effectiveness of the vaccinations.  By the way, I'm off at lunch time to get my booster shot.  Looking forward to it!

I'm of the mindset that these vaccines are highly overrated, not that they do nothing, but the efficacy rate certainly isn't the 94% + that these pharmaceutical companies claimed.

I know of people who got both vaccines a month apart, and then went in to have a check of their antibody levels to find out that they had produced virtually zero in the way of antibodies.

Therefore zero protection.

My sister got the booster, and so did her husband.

Personally, I've got better things to do.  I'm not wasting another minute on this stuff.  If I get it, I get it.  If I die, I die.

I'm certainly not going to live the rest of my existence in fear.  smile
The booster is not much an inconvenience.  My wife and I are going to get lunch out, which is always fun and has been pretty rare, and then off to a pre-scheduled drive-through vaccination site for our appointment.  Vaccination should take 1/2 hour tops, including the 15 minute wait afterward.

I'm not living my life in fear either.  I personally think my chances of death from Covid are at about 0% since I am vaccinated already, and I don't have any co-morbidities.  I still have that youthful feeling of invincibility, even though you and I are both 60 now.  shocked

I'm hoping that the vaccine and booster keep me from getting sick at all.  Being sick sucks and I have a lot of stuff that I want to do this fall and winter, including traveling to visit my parents.  Seems like a small price to pay for some well documented "stay healthy" insurance.

My county is getting slammed right now - the whole state of Colorado is.  I'm not sure why, but our cases are way up.  I spoke with a Nurse Practitioner at the local walk-in emergency care facility last Thursday, and she is exhausted from the rising number of seriously sick, but not ready for the hospital, level of patients she is seeing each day.

Interestingly, from an evolutionary virology perspective, it is 100% delta variant in Colorado now, and has been since mid September.  See below.  That has something to do with the rising case numbers.

Stay well!  Jim

Seems like you do this to me quite a bit Richard, or you used to.  I don't believe that you have done this since Brian noted it a few weeks ago.  I also don't think you've put my name in a thread title since I asked you not to, which I appreciate.

Still,  I don't think the animosity toward Jim or Rod is necessary.  When you say that you wouldn't even say hi to Rod at a star party it makes me blue.  Especially given the backdrop of Darrian's nice TSP thread.

Seems to me that this forum ought to be a place where friends can dialog, sometimes even disagree profoundly, but within a backdrop of the friendship of a shared hobby/passion.  That is the way it is with most everyone.  See Darrian's thread.  I know you didn't ask, but I think you might be happier with less hating on people like Rod, James, and Jim and more willingness to be friends.  Just my opinion of course.  Jim

Yeah I know - kind of cheesy post on my part.  Still, I stand by it.  The difference between your attitude and Richard's is like night and day - even though your politics are pretty compatible.  Seriously, I sure as heck hope that you would greet Rod cordially at a star party, even if you share nothing with him politically.  There is a ton more to life than politics.

Hi Mel:

In 2021 the source of an idea matters a lot to the media.  Maybe it has always been this way, but it is now out in the wide open.

Just this morning RCP reprinted a long article about how the Covid lab leak theory became toxic to the press.  It was not so much that a vast swath of the press hates Trump, they do of course.  The point is more insidious.  The NYT, Washington Post and so on were arguably unduly influenced by China.  This is a long and contentious article of course, but one I think worth reading and thinking about.
