Getting paid to stuff the ballot boxes and illegally harvest votes

Still crickets.  Just in case I am being obscure, "crickets" means silence with soft background chirping... It's an old movie meme.   The gist is that Rich is hiding under his desk and refusing to answer any questions.

But, have a great weekend.  Probably will not log in again until Monday.  I'll answer any witty retort then!  Jim

Mike Pence to Federalist Society: Trump is wrong

Precisely!  Although I think that the symbolism of the gallows is part of the overall news story.  It does not deserve hype, it does deserve coverage. J

I do think the threat to Pence was real.  I said as much earlier in this thread and was mocked for it by the resident fool (Rich).  I am sure that the Secret Service Agents tasked with protecting Pence thought the threat was extremely real.

The actual threat to Pence is a lot different than whether or not this was a legit gallows.  This whole issue of whether the gallows was legit seems to be conflated by people like the fool with the broader issue of whether Pence (or anyone else) was in actual danger.  I am not conflating these issues at all.  Sorry if that was not clear.  For me, the physical gallows serves primarily as a symbol and it is indeed a hateful and potent symbol.

The insufficiency of the gallows doesn't mean righties get to dismiss them off-hand as some seem to think. The gallows are an essential part of the story and fed into the mob mentality of that day.
I typed my reply before reading this one.  As usual, I agree with James.  Jim

Greg can chime in Rod, if he chooses, but I agree, literally no one (except maybe Rich?) disputes that there were at least a handful of real nutjobs there.

One issue for our speculation is how many of the rioters would have harmed Pence, had they caught him?  I think it is less than "all of them."  I suspect it was more than three or four.  Other than that I personally don't really have an opinion.  How many actually entered the Capital?  My guess is that at least 50% would have shouted slogans at Pence had they cornered him, and left it at that.  Some might have tried to kill him.  More than 3-4 but less than half?  It is hard to guess.  Like Greg said, when the mob is enraged, people will do things they never would consider doing otherwise.

This is all just speculation.  Fortunately for Pence and his family, we did not have to find out how it would have gone.

p.s.  I see that the post I replied to is ancient.  Probably was an affect of parallel conversations.

Hi Mel:

I don't have any problem with a thread discussing Pelosi's fortune and how she did (or did not) exploit her office to amass her fortune.  That would be as good a topic as anything we discuss!

The non sequitur part was the weird juxtaposition of Rich's reply with what he replied to:

I agree that a directed verdict is very rare.  Not sure if the judge is a political hack though.  None of us (me included) has looked into the element supposed to be missing from the plaintiff's case.   It is most likely not political at all, it is really tough (almost impossible) under the law for a public figure like Palin to prove libel.  Jim

"The judge said Palin did not prove "actual malice," which is the standard her legal team had to meet in her defamation case. The landmark 1964 New York Times vs. Sullivan case specifies that public figures who sue for defamation must prove that the offender knew the claim was false or showed "reckless disregard" for the truth.

The Times said all along that it made an honest error involving Palin -— and issued a swift correction. Palin argued that the publication smeared her on purpose."

This is just a snip from the CNN article, but it is not surprising.  "Actual malice" is an incredibly difficult thing to prove.  The Supreme Court confirmed this legal standard over 50 years ago in the Sullivan case.  https://en.wikipedia.org/wiki/New_York_Times_Co._v._Sullivan

So, to attribute this outcome in Palin's lawsuit to "a political hack judge" is extremely foolish.  Jim

Hi Brian:

Maybe, but Palin can still appeal if she wants to argue that the legal standard applied by the judge of actual malice is an unconstitutional standard (enormous longshot for Palin) or that the standard was misapplied by the judge (longshot too).

In other words, the jury applies the facts to the law.  The judge approves the jury instructions where the law is detailed for the jury.  If the judge got the law wrong in his jury instructions (presumably over Palin's objections) there could still be a viable appeal on the legal issues.  In any case, the appeal is a longshot.  Palin will have public sentiment behind her though, if the jury comes back in her favor.  That does not matter for the appeal, but it certainly would be a factor in her decision making process.  Jim
