Hi Mel and Greg:
Greg: I'm not saying that I agree with the liberal justices' Constitutional school of thought. Far from it. What I am saying is the the Constitution gives the President the right and obligation to appoint a Supreme Court justice when there is a vacancy. The Constitution gives the Senate advice and consent authority. This is the part of the Constitution I am respecting. The Senate makes it's own rules of course, and there is no filibuster for SCOTUS nominees.
As we sit today, the Ds have the presidency and the Ds control the Senate. This candidate is qualified as far as education, background, relevant experience and so on go. She is as qualified as any of the sitting Justices for sure.
So, her confirmation is a foregone conclusion, unless something really devastating comes up in her hearings, which is unlikely. She has been vetted before. I do not expect the R's to stoop to the dishonest, despicable, and ultimately unsuccessful levels the Ds did during the Kavanaugh hearings. In other words I sure hope the Rs do not make crap up to taint the impeccable reputation of this woman. That is not how I want my team to play the game.
Since her confirmation is probably inevitable, I would prefer the Rs to acknowledge her credentials, some should vote to confirm her and some can make a record that they do not agree with her judicial philosophy. Not much any R can do about it. So take the high road. How the Rs vote is not nearly as important to me as how they behave during the hearings.
Mel: I am not saying that the makeup of the Court is a petty issue. I'm not saying that at all! I am saying that this time the Ds hold all the cards. Elections have consequences. The R's lost the presidency and the Senate. This is the inevitable consequence. How the Rs take this setback (with class or not) is up to them. This should motivate the Rs to make sure that this is the only SCOTUS nomination Biden gets to make.
The Rs can handle this confirmation process with class like they did when Kagan, Ginsberg and Sotomayor were nominated. Or the Rs can do it like scum - like the Ds did when Bork, Thomas, and Kavanaugh were nominated. I think the class act will pay dividends in upcoming elections. Maybe I'm just a relic from a bygone era though...
