Sorry, I missed this the first time around. I find it boring to read everything that is posted here nowadays.
I posted my opinion of KBJ's qualifications (extremely highly qualified) when she was nominated. My understanding is that she has imposed sentences lower than the guidelines in some child porn cases. This is not surprising for a liberal.
This is not surprising for any judge. The guidelines are not mandatory, they are advisory:
https://www.law.cornell.edu/wex/federal_sentencing_guidelines#:~:text=The%20Guidelines%20are%20not%20mandatory,determining%20a%20criminal%20defendant's%20sentence.
Sentencing is very context sensitive. It requires a great deal of thought and insight to be just. Since we know nothing of the context of the child porn criminals KBJ sentenced, it is impossible to determine if we agree or disagree with her sentence. Likely enough, both you and I would be harsher judges when it comes to sentencing. That does not make her a radical, unless one has an incredibly self-centered world view of course.
Interestingly, according to some research I found persuasive, 2/3 of
all sentences handed down in child porn cases are below the guidelines. This would include sentences handed down by liberals and conservatives alike. https://sentencing.typepad.com/sentencing_law_and_policy/2022/03/contextualizing-judge-jacksons-mainstream-sentencing-record-in-federal-child-porn-cases.html
So, there is no way that this factoid about sentencing paints KBJ as a radical. Sure, she is a liberal, a highly qualified liberal, but certainly not a radical.
