I was posting that it would be ridiculous to claim since Mel (for example) never spoke out against Fox News and their collaboration with the Trump White House, it means he agrees with and condones the behavior. A fallacious line of reasoning that someone here puts forth all too often.
We appear to identify Mel's main point differently.  No worries there.  We agree completely that Rich's penchant for the "silence is acquiescence or endorsement" fallacy is entirely bogus to the point of idiocy.  Jim

Hi James:

I would guess that maybe 75% of the voters do not know what the WHCD is, and those who do know, don't care.  Still, this sort of back-slapping "aren't we elites so darned special" affair could not be more tone deaf if it tried to be.   First, the whole Trump phenomenon could be described as a revolt against our elites.  Hatred of elites is oxygen to people like Richard.  Second, Trump did not participate in the WHCD (before the pandemic cancellations).  Does anyone need additional evidence whom the elites in the press, government, and entertainment favor?

Last and most importantly, there is a war raging in Europe.  Inflation is rampant such that regular folks are unable to by gas and food.  The specter of recession has again raised it's head.  The markets are in the tank.  I personally can't go "all in" and blame Biden for everything, but his poll numbers are abysmal.  The only people with lower poll numbers are the press (as joked by Biden at the WHCD) and of course the Vice President.

A potentially cataclysmic mid-term looms for the Ds.  And yet the Washington press corps, the government, and the beltway elites choose to go ahead and renew their over-done celebration of themselves.

Smarmy left-wing Trevor Noah as the MC??  Tone-deaf does not begin to describe it.  This is Marie Antoinette like!

Jim

p.s.  I don't like the Oscars, Emmys and so on either.  I guess I'm an anti-elitist at heart too.

p.s.s.  I forgot the pandemic.  It's over as far as I'm concerned, but many of those scolds at the WHCD are telling us otherwise.  Hypocrisy much!

p.s.s.s  Since no other right-winger besides me has vented about the WHCD, I guess they all approved of it!  wink

Rod, I don't get it.  Mel explained that the OUS was an accident.  It is not exactly like OUS has some derogatory meaning.

When you or anyone else gets upset and threatens to bring Herb into the discussion, that is where I decide to stop dialoging with that person.  At least for a while.  Is that your goal here, to further stifle communication?  Jim

You are overreacting a lot, in my opinion.  Mel had a "LUDICROUS" in his post.  He obviously made some sort of typo!  As far as nastiness and dirty tricks go on this forum, Mel does not even make the top 5 abusers.

Rod, I am trying to get this clear in my mind.  Do you (or the TOS) have a problem with any truncation of the quote in the quote field, like I did above as an example?

This sort of truncation seems like a good and useful idea to me.  It promotes clarity, especially when one is replying to maybe one sentence of a 50+ line original post that covers many topics.  I have done this sort of truncation routinely.   I see nothing in the TOS that would prohibit this.  I looked at paragraphs 4, 15, 19, and 21 but might have missed something.

Maybe.

"Deliberations on controversial cases have in the past been fluid. Justices can and sometimes do change their votes as draft opinions circulate and major decisions can be subject to multiple drafts and vote-trading, sometimes until just days before a decision is unveiled. The court’s holding will not be final until it is published, likely in the next two months."

"Under longstanding court procedures, justices hold preliminary votes on cases shortly after argument and assign a member of the majority to write a draft of the court’s opinion. The draft is often amended in consultation with other justices, and in some cases the justices change their votes altogether, creating the possibility that the current alignment on Dobbs v. Jackson Women’s Health Organization could change."

Roe Vs Wade Overturned

Another question: Why are you not vocal, speaking out about abortions in this nation, whenever the subject comes up?

Last question:  Are you of the similar Opinion to RK, that if it is overturned, that the "A Team headed by Samuel Alito is deciding the Law of the Land"?
Richard, I have written extensively about this before, maybe it was before your time?

On a personal level, I have been pro-life forever and personally think about abortion as a sin, although I am not nearly as confident in my faith as I once was.

Even so, I am not nearly as willing as some folks to substitute my personal beliefs for the personal beliefs of another.  Many people, 50% or more, believe that many  abortions are a medical procedure performed by a woman on her own body.  I respect their positions, even if I do not agree.  I have thought about this a lot, and my uncertainty on a key legal/philosophical issue is why I am not carrying signs in front of Planned Parenthood even though I generally disagree personally with the pro-choice crowd, especially the activists.  This explanation below is why I am not "vocal" to directly answer your question, although I've never avoided the topic when it comes up here.

In my mind, the key legal issue is: "when do humanity and therefore human rights attach to this fetus such that his right to life supersedes the mother's rights to control her own body."  It's a balancing test.  I think it is a shame so few activist on either side see it this way.  You probably do not, your unshakable certainty in the correctness of your opinions is possibly unmatched.

On the issue, some would say humanity and human rights attach "at conception."  Others would say "at or near birth."  Other would say, "why does it matter?"  To this third group I would reply that we legally kill non-human creatures every day for food, sport, safety or even convenience.  Since these non-human creatures do not have human rights that is OK.  (Obviously many disagree)  I think this issue is important.  Somewhere along the line from fertilization to birth "humanity" and "human rights" do attach to the growing fetus.  Defining the point where humanity and human rights are acquired by the growing fetus is a tough legal question if God is taken out of the equation.  Heck, it is a tough religious question in my mind.  It is doubly tough, because the mother and the fetus might both have human rights that must be weighed against each other.  Because of the uncertainty inherent in this complicated issue, I respect those who disagree with me, within reason.  I am confident enough that humanity occurs well before a fetus is born, and therefore I fully support late term abortion bans.  I might personally regret the existence of each abortion, but I do not think that early abortions, especially those long before fetal viability outside of the womb should be banned.  I have too much respect for the other side of this debate to support fully outlawing abortion.

Here's another personal thought that I was discussing with my wife just the other day:  Abortion is characterized by feminists as a woman's rights issue.  An unintended consequence of readily available abortions and universal birth control is that males are encouraged to follow their nature and sleep with whomever they can convince to sleep with them.  The consequences are much lower from the male perspective than the consequences were two generations ago.  Women on the other hand are, in my experience, wired differently.  Women continue to bear nearly the entire psychic burden and huge self-esteem hit of disappointing casual sex and abortion.  I digress.  Probably this line of thought is a paternalistic enough heresy to get me cancelled, but I think it is a valid point.

Legally I think Roe was wrongly decided.  The Court should not have identified a penumbra to the bill of rights and then used it to legalize abortion.  The Court in '73 should have said that medical procedures are controlled by the state, so let the states legislate as desired.  I do recognize the flaws in this analysis.  Still, if Roe is stricken down, the states already have and/or will act to legalize some but not all abortions.  Some states will have effective bans.  I am OK with state by state regulation, even though travel across state lines to get an abortion is an unfair burden on the poor.

I do agree with Rod that the Supreme Court is more or less deciding "the law of the land."  But only on the less important federal level.  As noted above, the states have the final say.  The Supreme Court set the federal "law of the land" in '73 when they decided Roe.  They can do it now differently.  On an issue such as abortion, it is proper that the Supreme Court has final say on the federal laws on the topic.  I don't think this is controversial, or that Alito is a hack like Rod does.  I also think that a lot of justices are going to be adding their analysis to the 1st draft before it is published as the law of the land.

Last word, the midterms were lining up nicely for the Rs.  If Roe is stricken in June, this could be the sort of issue that flips the narrative and distracts the voters from the economy.  Politically, the timing could not be better for the D's, except maybe in a presidential election year.

The result may be the same, but maybe not.  This sort of leak might change some votes.  For sure Roberts is going to try to drive some sort of compromise.

Hi Mel:

There will be a lot of speculation about the motives of the leaker.  Is it simple Court intimidation?  Is it a coordinated D dirty trick?  Did Roberts do it to help him negotiate a compromise? (I just made that unlikely one up).  Personally, I think that the intimidation angle makes the most sense.  There has been a lot of intimidation and unwarranted disrespect thrown at the Court and the justices in the national press and even here.  Rod divides the Court into Saints and Hacks.  Richard does the same thing in reverse.  RBG must be rolling over in her grave.

I certainly hope that they catch the leaker.  If it is a clerk, I hope the perpetrator is disbarred.  Whomever it is, I hope he/she and their accomplices are prosecuted, if the leak is a crime.  (I have no idea if it is).  If this is a legit February Draft, then a lot of work has been done on the final draft between now and then.  If this is a fraud, I would love to see the perpetrators caught and exposed.  That would be the mother of all backfires.

Hi Russ:

Me too.  For starters, most states have legalized abortion already.  Those that will ban it have very few clinics where one can get an abortion today (I think that is correct, could be wrong.)  I have not looked at abortion statistics recently, but I understand that the trend per capita has been downward, although economic pressures may have caused a reversal.

Compassion and support for young pregnant women and proper fathering to young men before they procreate is the way to decrease abortions overall, not legal opinions and raging social battle lines.
