Another reality headed your way is the backlash against the GOP that will manifest at the polls and the federal legislation enacted by Congress to protect other rights similarly based on privacy constructs that may eventually lead to federal protection for abortion rights. Your side will lose the war if the Democrats capture Congress in the mid-terms. And there is some evidence that the Democrats will not do poorly.
Hi James:

Unless the economy flips soon, the Ds are going to get slaughtered in the midterms.  That said, I think that most states will ultimately protect a limited right to abortion and a federal law like France's is not out of the question.  To the extent a person defines winning as a nation wide abortion ban, that war was lost many years ago.   Jim

Regardless, when I said the GOP won the war, I meant concerning getting Roe overturned.
All understood.

Still, if Trump is indicted and prosecuted it will hurt the Ds.  (I would be fine with it).  It would rally the Trump base and if Trump were disqualified from running in '24 the Ds would lose their biggest fund raising and GOTV motivation.  I hope it happens.

I think Roe was a 50 year detour and distraction from the real war.   The real war being social acceptance of limited abortion (at least in my view of the real war).  Roe forced acceptance on a public where the majority was not in favor of it.  Forced acceptance by the majority of an unwelcome change happens by design when a genuine constitutional issue is decided by the Court, but the constitutional case for Roe is/was weak, compared to the equal protection cases in Obergefell or Loving, for example.  The constitutional case for Roes predecessor Griswold is very weak too, but who cares if it is overturned?  I do not see any state legislatures clamoring to restrict condoms and BC Pills, although I have seen outlets like "Vox" predict it.  I'm skeptical.  J

I wonder if he has the necessary case.

Like the old saying goes, if you try to assassinate the King, you had better succeed.  Not saying Trump is the King, but if the DOJ has not laid a glove on him by 2024 the liberal base is going to be despondent and Trump supporters will be feeling invincible.

Add that to McConnell's statement that a national abortion ban is possible, presumably if the GOP takes control, the quoted statement will be an understatement...
A national abortion ban is not practical at this time.  I don't see an R house, a filibuster-proof R Senate and an R president any time soon.  If that comes to pass in 2024 or afterward, I do not think the political will would be there.

It might take an R house, a filibuster-proof R Senate and an R president to pass a reasonable national abortion law like France has.  You guys would act as if any restriction was the end of the world of course, but it would be the best compromise possible for pro-life and pro-choice partisans.

Did you read the article you posted?  Either the Dr. violated the disclosure laws and privacy laws or she did not.  Her employer (one of my alma maters) supports her.  If she complied with the laws, the no problem.  Or maybe you would prefer that the rule of law be abdicated in these circumstances?  Jim

Are you that unfamiliar with the history of politics in this nation back during the early elections?

How many of them would you have imprisoned?

Some of them, some very prominent ones, called for outright violence in overturning elections.  Would you have jailed them as well?

Would you have imprisoned anyone during the Jefferson/Adams election?

I guess I must be missing your point.  Can you elaborate?  Are You "fine with it", because you think Trump is guilty or are you "fine with it" simply because you think it would destroy the Dems?

Either way your statement is one of the most irresponsible ones and one of the most irresponsible suggestions I've ever heard posted here.

I expect it from the Dems, but you......?
On my phone, so pardon any typos.  I am fine with Garland prosecuting Trump if the DOJ shows probable cause for a prosecution.   See line one of my earlier post.   If no probable cause is shown, then I oppose prosecution with my heart and soul.   I have not pre-judged anything.

Yes, of course, but the prosecutor has to bring a prosecution first.  As far as this being a big national story that has cast the Dr. into the national spotlight...  Who made this into a national story?  You should know since you have followed it more closely than me.  My guess is that it was not the Indiana AG who made this into a national story....

The point is, Darian, that the conservative decision to overturn Roe is not without consequences for conservatives. And some of those consequences are due to the haphazard and chaotic implementation of post-Roe abortion access. Like it or not, abortion is the correct medical procedure in many cases, such as an ectopic pregnancy or a pregnancy where the fetus has died or cannot otherwise survive outside the womb. For example, here in Texas, it's energized women to vote Democratic in upcoming elections, as evidenced by polls and a slate of new ads that oppose our current leadership that focus entirely on the harm and suffering caused by the overturning of Roe.
This is something I predicted a decade ago.  I think you and I have discussed in the distant past how Roe provided cover for conservatives.  They could talk the talk without having to walk the walk.  That has changed now, and I agree this is a huge momentum boost for the Ds.  Still, I think that momentum boost is mitigated or maybe overwhelmed by the economy and other newsworthy events in this particular election cycle.

Contraception access is likely not in jeopardy, but what about marriage equality? The GOP and some red-states have been signaling it is in their sights.

When Roe was passed, a majority may not have favored it, but it was overturned when a majority was in favor of it. With time we will find a balance of limited abortion that is necessary and fair. In the meantime, though, there is a lot of hurt and suffering to be endured on the way there.
Marriage equality is well grounded in the Equal Protection Clause.  I'll see if I can find my original post on that from maybe 15 years ago.  Roe was not well grounded in the Constitution.  Maybe this only matters to lawyers, but I think this is the motivation behind conservative justices like ACB, BK, NG, and of course Thomas.  I do not see ACB, NG, and BK touching the Equal Protection Clause cases granting gays, blacks, and others full access to marriage.  Not sure about Thomas.  Jim

Also, James, the backlash you have been talking about is real.  Only right wing lunatics would want to exacerbate this backlash by proposing laws banning gay marriage at this point in time.  Sure there are plenty of right wing lunatics out there, but are there enough?  Would anyone on this forum support banning gay marriage in their state as of July 2022?  Jim

Yes.  I get your point.  But I also think that those state legislatures will work to remedy the most burdensome miscarriages of justice.  They do want to stay in office.  I think the abortion activists are highlighting every perceived issue, as if some extreme edge cases justify Roe, the Constitution be damned.  I heard on the radio just today the argument that disposing of un-implanted but fertilized embryos is now a felony in many states.  I don't know if that is true, but if it is, look for the various state legislatures to take action.  They will want to do it quietly in red states, but they will do it.  Jim
