The immunity decision does, however, offer the protection from prosecution for presidents engaging in acts of malfeasance such as those by Trump or Nixon, with the latter likely not resigning under the umbrella of privileged communications while in office.
Good gracious Rod, how can you say this!!!   On one hand you think Bondi is ready, willing and able to ignore a Supreme Court ruling, and on the other hand you don't think she would prosecute Biden for his executive orders enabling illegal immigration (orders that violated existing statutes!)  You can't be that naive.  Am I missing something?  Does anyone else not see the benefit to Biden of the Court recognizing immunity from criminal prosecution for acts within the scope of executive authority?

Hi James, Jim - thanks, and no worries.  I actually think Rich understood my point.  Sadly, Rich lies so easily, for example, that he did not put "The TORMENTOR" on his own account profile, that I don't know what to think when he grossly and laughably misstates one of our points of view.  Either Rich is a pathological liar, or he has a serious, disabling mental illness.  Either way, I'm happy to ignore him.

I did put in another post that I was 99% certain that our Constitutional system would hold if Trump provoked a constitutional crisis.  I'm still good with that number although it may be too optimistic.  Heck, according to the ESA on the A-Mart front page, we are only 98% certain that a fairly large asteroid AR2024 AR4 will miss Earth in 2032!   Not much is 100% certain!

One thing I am sure of is that you guys, Russ, David, Rod, and anyone else who reads the posts here understood my points.  J

That said, I'm wondering you make of the parade of DAs in New York resigning in protest over Trump's DOJ's efforts to force them to drop the corruption case against the mayor of New York city in wake of his cooperation with Trump to go onto Fox and Friends to champion Trump's stance on illegal immigration?

I understand the head who resigned is a staunch conservative/republican and a dedicated member of the federalist society.

Sorry, I don't know yet.  The headlines sure look bad.  I'd want to read a lot more about it before I stake out an opinion on this.

This is the typical republican playbook at work, defund a program or agency until it performs badly or fails outright and then point to it and say, "ya see it doesn't work and we were right all along."
I think Rod, that if you read Richard’s reply again you’ll see that he was admitting that you were right and he was wrong regarding the statutory founding of the Department of Education.   As close as he ever gets to such an admission anyways.

Basically Congress passed a statute and Carter implemented with his orders.   Maybe the agency has morphed and grown into something different than contemplated in the 70s.   That would be typical.

The reason I am bringing this up is that the EO creating DOGE did not create it from scratch.   On the contrary, the EO creating DOGE renamed an existing agency division, one that presumably has never been questioned before.   I doubt that renaming is unconstitutional, but it is a good question when renaming involves a big change in scope.  We all know that agencies like Education and the EPA have changed in scope over the years.   Sometimes broadened scope has been found constitutional, sometimes not.   I think the original statute is the guidepost for the constitutional limits.   Recent example is the EPA losing the right to regulate carbon dioxide emissions because that was beyond the scope of the clean air act.

Here is the EO creating DOGE from an existing agency branch.

OT: anyone watching the four nations hockey tournament??

Maybe the Canadian fans shouldn't have booed the US national anthem?

The start of the game looked like a scene from the movie Slapshot. Where's Reggie Dunlop and the Hanson brothers when you need them? LOL.
I need to tune in, I love hockey, but college basketball controls my limited viewing time, this time of the year.

Veterans Affairs

USDS partnered with the Department of Health and Human Services to create data systems and predict needs for infant formula.

None of the above is consistent with the activities of DOGE. So, it seems they simply took the closest in appearance department and utilized it as a cover for justification of what it is really doing.

Will that withstand the scrutiny of constitutionality? My guess is that it will given the propensity of the conservative majority to ignore the merits of a case(except when it wants to further their own rationale for arriving at a decision) and so will grant Donald Trump (and Elon Musk) even more power to do what they're doing.

Speaking of Elon, have you wondered how it can be that while the musketeers are finding supposed cases of fraud and waste and abuse in virtually every department, they somehow can't find it in the billions of dollars in contracts that Musk and Starlink have with the US government? Every dollar of those contacts is perfectly allocated and spent? And that's just one "tidbit" of a merit of a case that the cons on SCOTUS will ignore...
If DOGE does exceed its constitutional authority, I think the cons on the Court will surprise you.   Not everything is politically motivated.

Notice how the case presented on behalf of the Trump government is chock full of issues of merit while the appellate court decision is a procedural matter.

Hmm, I wonder how the conservatives of the court will do with those...
I wonder what the liberals will do too.  Sounds like the Administration has good arguments, based upon your article.  Rather than viewing this through a conservative=bad, liberal=good litmus test, what do you think of the arguments below on the merits?

“Until now, as far as we are aware,” Harris wrote, “no court in American history has wielded an injunction to force the President to retain an agency head whom the President believes should not be entrusted with executive power and to prevent the President from relying on his preferred replacement.”

The executive branch has for nearly five decades, Harris noted, believed that the restrictions on the president’s ability to remove the special counsel violate the Constitution, because the power to make decisions about investigations and prosecutions falls squarely within the president’s power as the head of the executive branch.

As a general rule, Harris continued, the president can remove senior officials whenever he wants. Indeed, in two recent cases, Harris added, the Supreme Court has held that restrictions on the president’s power to remove the solo heads of the Consumer Financial Protection Bureau and the Federal Housing Finance Agency violate the Constitution. Based on those decisions, she observed, Biden in 2021 removed the head of the Social Security Administration."

Great sourcing on this issue by the way.  SCOTUS Blog is the best there is for Court issues.   The article on birthright citizenship lays out the issues really well too, although the administrations position is best articulated at the end.

Trump Falsely Claims "Ukraine Started The War"

If you really think Putin = Bin Laden,
If you really think Putin is not a legitimate leader,
If you really think a phone call is an outrage;

then it seems reasonable to ask if you and Canada are willing to support and encourage the US to invade Russia and eliminate the threat?  Just like we did with Bin Laden and Al Queda.   Are you really that eager for us to launch a nuclear WWIII?

I doubt it.   So, why oppose and ridicule efforts at diplomacy?   I suspect that you are reflexively opposing everything Trump does, just because he's Trump.
