Tennessee Three, well, actually the Tennessee Two

Posted By Rod Kaufman

The two were kicked out and a third spared because they supposedly violated a "rule of decorum" by engaging in the protest over gun violence on the floor.
These were, of course, elected to represent their constituents who no longer have a voice after being cancelled over exercising a constitutional right.
If the Democrats pulled this kind of crap,  the Cons would be screaming their heads off and proceeding with another congressional investigation...

But since you are the resident court jester, I'll give you the facts.

Here is the house resolution:  https://www.capitol.tn.gov/Bills/113/Bill/HR0064.pdf

From that document:

WHEREAS, during this time, Representative Johnson and her colleagues shouted,
pounded on the podium, led chants with citizens in the gallery, and generally engaged in
disorderly and disruptive conduct, including refusing to leave the well, sitting on the podium, and
utilizing a sign displaying a political message; and

WHEREAS, during this time, Representative Pearson and Representative Jones used a
bullhorn to amplify their protestations; and

WHEREAS, these actions were done in open session in the presence of, and witnessed
by, the members and staff of the House of Representatives; and

WHEREAS, it appears to the satisfaction of this Body that Representative Johnson's
conduct on March 30, 2023, constitutes disorderly behavior and justifies expulsion;

We all know that communists like yourself are happy to burn down buildings, murder people in the street to get their way, but there are places where sanity and calm decorum are supposed to be respected.

In some places of this nation, the sane world doesn't have to put up with the stupidity, anarchy, and basically assholishness of jackasses like yourself.

Deal with it DS.
Obviously that's the response we'd all expect from our resident dick: moronic commentary to justify moronic actions...

I thought y'all didn't like judges legislating from the bench?

What gives this guy the right to ignore the FDA and ban a drug? Because he says so? Imagine the noise we'd hear if a judge appointed by a democrat issued a ban on Viagra.

"In a motion filed Monday, the DOJ asked the 5th Circuit Court of Appeals to issue a stay pending appeal on a district court's suspension of mifepristone on Friday. The "abrupt and sweeping nationwide order" would "irreparably harm" patients, it argued."

"If allowed to take effect, the court’s order would thwart FDA’s scientific judgment and severely harm women, particularly those for whom mifepristone is a medical or practical necessity," the DOJ said in its filing. "This harm would be felt throughout the country, given that mifepristone has lawful uses in every State. The order would undermine healthcare systems and the reliance interests of businesses and medical providers."

Anyone care to comment? Or is this now okay for federal judges to do?
The drug in question actually has a safety record better than Viagra. He banned it ostensibly because he says the FDA didn't evaluate its "psychological effects", whatever that is supposed to mean. It's quite clear this Trump-appointed judge who previously worked for an anti-abortion religious group was selected in Texas to hear the case by the ultra conservatives who brought it after it was prepared by Josh Hawley's wife. The federal appeals court in Texas is also ultra conservative and, given that fact that another judge in another state issued an opposite ruling in a similar case, it's likely headed for SCOTUS.

The order is 64 pages of detailed reasoning.  One may disagree or one may agree with the judge's conclusions, but this was not put together in a hasty manner by an activist judge.

137 separate motions, briefs, and other court documents were filed by countless interested parties and considered by the court.   The docket is tabulated here with some summaries:  https://clearinghouse.net/case/43886/?docket_page=1#docket

The plaintiffs convinced this judge that more likely than not that the FDA did not follow it's own rules when approving mifepristone and misoprostol as a combination to accomplish abortion.  If you have time to skim the opinion, you will see why, and you will know more about the issues underlying this case than 99% of the morons writing about it in the press.  Another court disagrees, as you probably know, setting this up nicely for appellate court review.  Expect these drugs to be available while the appeals are argued.

I am posting only because the press has over-simplified the process that resulted in the Court's order to be basically: "a radical right wing judge outlawed the abortion drugs from the bench."  This is ignorance foisted on the public by the press.  The truth is that a District Court after reviewing mountains of evidence and arguments from both the FDA and medical professionals determined that the FDA did not follow it's own procedures when it issued an evolving series of authorizations for the use of these drugs to accomplish abortions.  Another Court disagrees as noted above.  This is a difficult case.  Bottom line though, it is the District Court's job to stay the FDA ruling if the fact show that they violated their own procedures.  This is basic checks and balances.

I have no idea if the plaintiffs or the FDA ultimately wins.  I just hate to see the beginning of a lengthy judicial review process reduced to a political sound-bite by the press.

Jim
Er, ah, I think the arguments noted above apply in the Federal court that found in favor of continuing the drug. I think it's clear from the judge in Texas, given his language in his arguments explaining his decision such as referring to defendants as "abortionists" and the like aptly display the bias on his part...

A Miracle: GOP Rep Actually Held Accountable For Elections Lies By Republicans!!!

Posted By Rod Kaufman

"State Rep. Liz Harris was expelled Wednesday from the Arizona House of Representatives for ethics violations resulting from inviting a conspiracy theorist to publicly testify before lawmakers earlier this year."
"The resolution to expel the first-term Republican, elected in November, stated that she had brought “disrepute and embarrassment to the House of Representatives,” resulting in “disorderly behavior.” Forty-six Arizona representatives in the GOP-controlled House voted to remove her from her elected position, meeting a two-thirds threshold to expel lawmakers."
"Harris is a well-known conspiracy theorist and election denier in Arizona. She was a constant figure during the GOP-led review of Maricopa County’s 2020 ballots. Election experts condemned the review calling it an attempt to overturn the state’s election results."

Gee, sure didn't take long. Once again we on the right were correct when it came to the law and the Constitution

After looking at this more carefully, this has not been decided:
"The court gave Jordan a deadline of April 17 at 9:00 a.m. to file any response before the final hearing occurs on April 19."
It's no wonder why I'm not seeing this same thing on Faux or elsewhere...
PS:  Jordan, being the arrogant hypocrite that he is, refused and ignored a lawful subpoena from the congress last year and should have been arrested like Navarro...

Speaking of Navarro:
"Appeals court rejects Navarro bid to block order to turn over emails"
Peter Navarro lost his bid to block an order that requires him to hand over hundreds of emails sent during his tenure as a White House adviser during Trump administration to the National Archives."
"A three-judge panel on the D.C. Circuit Court of Appeals determined that “there is no public interest in Navarro’s retention of the records, and Congress has recognized that the public has an interest in the Nation’s possession and retention of Presidential records,” according to a Wednesday filing shared by NBC News."
